How we work together

Terms of Service

These Terms of Service (the "Terms") form a legally binding agreement between you ("User" or "you", and, where relevant, "Model") and Rubrissa Agency ("we", "us", "our"). They set the rules for your access to and use of the website at https://www.rubrissa-agency.com and of every sub-page, form, tool, dashboard, communication and resource we make available (collectively, the "Services").

Whenever you access or use the Services, you confirm that you are 18 or older (or have reached the age of majority in your jurisdiction, where that is higher), and that you have read these Terms, understand them and agree to be bound by them and by all applicable laws. If you do not agree, you must not use or access the Services.

  1. AGE AND IDENTITY

You must be 18 or older and have the legal capacity to sign a contract. We may ask for valid government-issued photo ID during onboarding to confirm your identity and age.

  2. CONTENT YOU OWN

You keep ownership of your original, lawful content. Content you submit to us is licensed to us only to deliver the Services and for internal training, and it appears in promotion only with your explicit consent.

  3. NO GUARANTEED EARNINGS

No income is guaranteed, and all earnings figures on this site are illustrative. Tax and regulatory obligations in your jurisdiction are yours alone.

  4. ZERO TOLERANCE

Strictly prohibited: the involvement of anyone under 18, any non-consensual act, trafficking or exploitation, doxxing, threats, hate speech, illegal drugs, the promotion of self-harm, and any other unlawful activity.

Section 01

Definitions

"SERVICES"

The website and its forms, together with the communications, coordination and supporting tools provided by Rubrissa Agency.

"MODEL"

Any adult who applies to, or works with, the agency in webcam modeling or related promotional work.

"USER"

Any person who accesses the Services, be it a visitor, an applicant, a model or someone else.

"CONTENT"

All material created or submitted by a Model, such as text, images, audio, video, performances and metadata.

"THIRD-PARTY PLATFORMS"

External websites and services, including the industry's streaming sites, where a Model can perform or publish content.

"PAYOUT"

Any amount, gross or net, that becomes payable, subject to agency agreements, platform fees, chargebacks and compliance holds.

Section 02

Accepting these Terms

Using the Services signifies your acceptance of these Terms. Any further guidelines or policies we publish within the Services are incorporated into these Terms by reference. Where the two conflict, explicit supplemental terms take precedence.

Section 03

Eligibility and identity checks

  • You must be 18 or older, or have reached the age of majority in your jurisdiction if it is higher.
  • You must have the legal capacity to enter into a binding contract.
  • On request, you must provide valid government-issued ID, and we may also request a second ID document to help prevent fraud.
  • You agree that the information you give us will be complete, accurate and current, and that you will update us promptly if it changes.
  • We may refuse or revoke access at our discretion if you fail to comply or if we identify a risk.

Section 04

Our role as an agency

Rubrissa Agency acts as an agency, coordinating and supporting the talent it works with. Our help covers onboarding, basic guidance, scheduling and the overall positioning of your brand. Model Content shown on Third-Party Platforms is not published by us, and those platforms apply their own policies. Nothing in the Services guarantees bookings, earnings, audience size or promotional reach.

Section 05

Account security

If you are given access to one of our internal portals or dashboards:

  • Protect your login credentials, and notify us immediately of any unauthorized access.
  • Your login is for you alone. An account may be used by more than one person only with our written approval.
  • We may suspend any account during an investigation into a suspected breach, fraud or violation of policy.

Section 06

Model responsibilities

  • Ensure that all Content meets the laws that govern it, including requirements for consent, age verification and record-keeping.
  • Give your performances in a safe, lawful setting, and never promote or portray illegal acts.
  • Respect the intellectual property of others, and do not use music, images, video or trademarks without a license.
  • Do not engage in deception or fraud, such as "chargeback" schemes or the misuse of someone's identity.
  • Where you collect personal data from subscribers or fans yourself, process it in line with privacy laws.
  • Inform us promptly of any strike, warning or legal notice from a platform that relates to your performances.

Section 07

Support we offer

Within our capacity, and while compliance continues, we may:

  • Offer general best-practice guidance and performance tips, and help you structure your schedule.
  • Provide limited administrative assistance, for example with opening accounts on permitted Third-Party Platforms.
  • Comment on your branding or optimization, without necessarily covering every point.
  • Review ID documents in-house for compliance purposes, holding them securely for no longer than lawful purposes need.

We do not act as your lawyer, tax advisor or professional financial advisor.

Section 08

Prohibited conduct

The following, among other things, are strictly prohibited:

  • The participation or depiction of any person under 18, or of anyone who cannot give legal consent.
  • Human trafficking, coercion, exploitation or any non-consensual act.
  • Harassment, intimidation, threats, hate speech or incitement to violence.
  • Disclosing another person's personal data without lawful authority ("doxxing").
  • Promoting self-harm, or glamorizing dangerous behavior.
  • Supplying illegal narcotics, or providing instructions for unlawful activity.
  • Material that violates intellectual property rights or rights of publicity.
  • Using automated tools to scrape platform systems, or reverse engineering those systems, without consent.

We may assist law enforcement with legitimate inquiries, and we will take down suspected material, or limit access to it, where required by law or by our good-faith compliance duties.

Section 09

Ownership of the Services

Except for Model Content, all elements of the Services, such as the text, design, graphics, code, branding and trademarks, belong to or are licensed to Rubrissa Agency and are protected under intellectual property laws worldwide. Copying, adapting or translating any of them, or creating derivative works from them, requires our prior written consent.

Section 10

Rights you grant us in your Content

Ownership of the lawful Content you create stays with you. By submitting Content to us, or giving us access to it for support or promotion, you grant us a license to use it and to host, store, display, analyze and transcode it (for instance, to check quality or compliance). This license is worldwide, non-exclusive, royalty-free, transferable and sublicensable (to our infrastructure and service providers), and applies solely to: (i) delivering the Services; (ii) internal training and optimization within the agency; (iii) showing what the agency can do, in neutral terms and only with your explicit consent. You can withdraw consent for promotional display by notifying us in writing, though copies may linger in operational caches and backups for a reasonable time.

Section 11

Using Third-Party Platforms

Every Third-Party Platform sets its own terms, and reading and complying with them is your responsibility. We accept no liability for platform outages, policy changes, moderation decisions, monetization rules or data loss on those platforms.

Section 12

Earnings, payouts and taxes

  • We make no guarantee of traffic, conversions or any specific level of earnings.
  • Payout timing can be affected by compliance holds, fraud checks, minimum thresholds, clearance periods or Third-Party Platform payment cycles.
  • Refunds, chargebacks or platform penalties may reduce, or be offset against, future payouts.
  • You alone are responsible for reporting and paying all taxes and social contributions that apply to you, and for any obligation to register or withhold in your jurisdiction.
  • Statements we provide are informational and do not constitute tax advice.

Section 13

Data protection

Our Privacy Policy describes how we handle personal data. If you process viewer or fan data on your own, you act as a separate controller (or data steward) for it and must comply with the laws that govern it, for example the GDPR and any local marketing-consent rules.

Section 14

Reporting infringement (DMCA)

Rubrissa Agency respects intellectual property rights. If you believe something on the Services infringes yours, send a full notice to contact@rubrissa-agency.com. Your notice should identify the work concerned and the URL or a description of the infringing material, and should include your contact details, a good-faith statement and a declaration made under penalty of perjury. We may request additional verification, and a person who misrepresents a claim may face liability under applicable law.

Section 15

Disclaimer of warranties

The Services are provided "as is" and "as available", without warranties of any kind, express or implied. This covers, without limitation, any warranty of accuracy, uptime, uninterrupted availability, title, non-infringement, merchantability or fitness for a particular purpose. We do not guarantee earnings, audience growth or acceptance by any platform, nor protection against unauthorized copying of content on other parts of the Internet. Where a non-waivable warranty is implied by law in your jurisdiction, it applies only as far as the law strictly requires.

Section 16

Limitation of liability

To the fullest extent permitted by law, Rubrissa Agency and its officers, directors, employees, contractors and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, for any loss of profits, goodwill or data, or for any service interruption, even where advised that such losses could occur. Our aggregate liability for any claim arising out of or relating to the Services or these Terms is capped at the greater of EUR 100 (one hundred euros) and the amount (if any) you paid us during the 3 months preceding the claim. Certain jurisdictions do not allow some of these limitations; in those jurisdictions, they apply to the maximum extent the law permits.

Section 17

Indemnification

You will defend, indemnify and hold harmless Rubrissa Agency and its officers, directors, agents, employees and affiliates against any claims, damages, losses, obligations, liabilities, debts, costs and expenses (including reasonable attorneys' fees) arising from: (i) your use of the Services; (ii) your Content; (iii) your breach of these Terms; (iv) your infringement or other violation of a third party's rights; (v) your breach of the law.

Section 18

Suspending or closing access

We may, with or without notice, suspend or terminate your access if we reasonably believe that you have breached the law or these Terms, or that you present a risk. You can ask, in writing, for your access to be closed. Sections intended to survive termination will do so, including sections 9, 10, 15, 16, 17, 19 and 20. Operational data may remain in lawful backups for a limited period.

Section 19

Governing law and jurisdiction

These Terms are governed by the laws of the Netherlands, disregarding conflict-of-law principles, except where mandatory local law provides otherwise. Any dispute that falls outside the alternative resolution provisions of these Terms is subject to the non-exclusive jurisdiction of the competent courts in Amsterdam.

Section 20

Settling disputes

You agree to attempt an informal resolution before bringing formal proceedings, by sending a detailed account of the dispute to contact@rubrissa-agency.com. If the matter remains unresolved after 30 days, either party may pursue the remedies permitted by law. The parties may also agree to resolve it by mediation or confidential arbitration. Nothing prevents either party from seeking an injunction or other equitable relief in relation to alleged misuse involving intellectual property or data security.

Section 21

Updates to these Terms

We may change these Terms at any time, and we may highlight material changes prominently on the site. If you continue using the Services after a change, that use counts as acceptance. If you do not accept the change, stop using the Services.

Section 22

General provisions

  • Should any provision be held invalid, the remaining provisions continue to be enforceable.
  • A one-time waiver of a term is not a continuing waiver, and a failure to enforce a term is not a waiver of it.
  • You may not assign these Terms without our prior written consent. We are free to assign them to an affiliate or successor.
  • Section headings serve only for convenience.
